1. Ownership & Copyright

I retain full copyright and ownership of all photographs I create during any session. Ownership of images may only be transferred if both parties agree in writing and a fee per image or package is agreed upon in advance. Clients do not automatically acquire the right to use, reproduce, sell, or distribute images unless such a written agreement granting full rights is signed. Any images provided free of charge or for promotional purposes must always include proper credit to me.

 

2. RAW Images

RAW image files are never provided unless explicitly agreed in writing and purchased as part of a full rights package. Clients will receive only the final edited high-resolution images unless other arrangements are specifically agreed upon in writing.

 

3. Delivery of Images

All images will be delivered via an online gallery, which will remain accessible for six months after delivery. Clients are strongly advised to download all high-resolution images promptly, as the gallery will expire after this period. I maintain secure backup copies of all images on the cloud to ensure their safety and integrity.

 

4. Booking & Payments

To secure a photography session, a 50% non-refundable booking fee is required. By paying this fee, clients confirm their agreement to these Terms & Conditions. The remaining 50% must be paid on the day of the shoot, either before my arrival or upon arrival at the location. The booking fee is not a deposit and is non-refundable under any circumstances.

Clients are expected to arrive on time; any time lost due to lateness will reduce the allocated shooting time accordingly. Rescheduling requests must be communicated 24–48 hours in advance, and I may accommodate these at my discretion. Clients who fail to attend a session without notice forfeit the session entirely and will need to re-book with a new fee. Exceptions may be considered at my discretion for extenuating circumstances.

 

5. Usage & Credit

Clients may use the delivered images for personal purposes or any purposes specifically outlined in the agreement. Any commercial usage, resale, or redistribution of images requires prior written permission.

If a client submits or uses my images for modelling agency portfolios, magazines, news outlets, social media accounts, or any platform where the images will be used or advertised for marketing, promotional, or related purposes, those images must always be credited to me. Images provided free of charge must also include proper credit at all times.

 

6. Model Release & Privacy

By booking a session, clients grant me permission to use any images I create for promotional and marketing purposes, including but not limited to social media, portfolio displays, competitions, advertising, and other professional marketing channels. I also reserve the right to sell images to third parties.

For nude or semi-nude images, explicit permission must be obtained from the client before posting to social media or using for marketing purposes; however, these images may still be included in my professional portfolio.

This clause applies to all clients unless otherwise specified and agreed to in writing by both parties. I respect client privacy and will not share personal information without consent.

 

7. Client Responsibilities

Clients are responsible for punctuality, communication, and providing any specific instructions or requirements ahead of the session. Clients must ensure that any locations, props, or models comply with applicable laws and regulations. Clients are also responsible for securing permissions for private property or restricted locations if needed.

 

8. Cancellation & Rescheduling

Cancellation of sessions does not entitle clients to a refund of the booking fee. Rescheduling requests may be accommodated at my discretion, particularly in emergencies or under extenuating circumstances. Communication within 24–48 hours prior to the session is required for rescheduling considerations.

 

9. Liability & Gear Responsibility

I will take all reasonable care during sessions to ensure safety and professionalism. However:

• I am not liable for any personal injury, damage to property, or unforeseen circumstances beyond my control.

• If any of my equipment is damaged, lost, or stolen as a direct result of the client, any affiliated parties of the client, or any service providers or staff hired or instructed by the client, including through negligence, interference, or unauthorized handling, the client is fully liable for the replacement cost or any insurance excess required to repair or replace the items.

• If I leave any items unattended in an area that the client has instructed me is safe, and damage or loss occurs, the client will also be held liable. If items are left in areas not previously agreed as safe, liability rests solely with me.

• Damage, loss, or theft occurring solely due to my own negligence, such as dropping equipment or leaving it unattended in unsafe areas, is my responsibility.

Clients agree to respect my equipment at all times and not touch or handle it without express consent. Any unauthorized handling that results in damage or loss will be considered the client’s responsibility.

 

10. Additional Services & Fees

Any services requested beyond the agreed session, including additional shooting hours, special retouching, or specific image manipulations, may incur additional charges. A travel fee of R5 per km applies for any locations outside my standard operating area. Clients are responsible for covering these travel costs.

 

11. Acceptance of Terms

By paying the booking fee and proceeding with a photography session, clients confirm that they have read, understood, and agreed to all of these Terms & Conditions. These terms apply to all services unless otherwise specified and agreed to in writing by both parties.
